When officers instructed Kintz to take his hands out of his pockets, he complied, but then 'swiftly' pulled a screwdriver from his pocket and lunged at Officer Shaffer, stabbing at the officer's head and neck. Shaffer and Officer DeFord fired at Kintz, who collapsed. Kintz subsequently died at the hospital from his injuries. Kintz's family told police he was aware he had a warrant for parole violation and would not go back to prison, and if police made contact with him, he would try to stab them and make them kill him.
