Shaffer and Officer DeFord fired at Kintz, who collapsed. Kintz subsequently died at the hospital from his injuries. Kintz's family told police he was aware he had a warrant for parole violation and would not go back to prison, and if police made contact with him, he would try to stab them and make them kill him. When the woman stopped at a gas station, officers saw 43-year-old David Leroy Kintz Jr. exit the car with a duffel bag and walk away. Two patrol officers, Titus DeFord and Neal Shaffer, were called in to make contact with Kintz.
